8/4/2015 – OKC, OK — Notorious Oklahoma City pimp and human sex trafficker Mario Diaz is denied his latest effort to shorten his current prison sentence. JohnTV’s own Video Vigilante Brian Bates confronts Diaz (and a bully, possibly racist D.O.C. guard) as Diaz is escorted back to prison.

On Aug. 20, 2013 Diaz pled guilty in an Oklahoma County courtroom to felony racketeering charges and also separate charges of domestic abuse with great bodily injury and intimidation of a state’s witness – all directly tied to Diaz’s prostitution and human trafficking efforts. Despite evidence that Diaz was an incredibly violent pimp who made over $200,000/month, literally off the backs of women, the Oklahoma County DA’s office agreed to a sentence of only 10-years in custody, followed by 10-years of probation. Diaz never faced criminal prosecution for actual pimping or human sex trafficking and will not have to register as a sex offender upon eventual release from prison.

At the time of sentencing, the Oklahoma County DA’s office also agreed to a ‘judicial review’ to be held on Aug. 3, 2015. A judicial review is an opportunity for a defendant to try and convince a judge to reduce their current sentence.
JohnTV’s own Brian Bates was in the courtroom yesterday when Diaz and his attorney made their plea for a reduction in Diaz’s current sentence. Also present were 13 friends and family of Diaz’s who came to show their support for him. Bates recognized several of those in attendance; a niece, brother, sister-inlaw, cousins and Diaz’s mother, among others.
Oklahoma County Judge Ray Elliot was brief in his response to the motion… “I’ve read the law and its clear. I can’t modify your sentence unless the District Attorney’s office agrees to the modification and they have indicated they do not. So, I can’t modify your sentence. Motion denied.” Judge Elliot went on to tell Diaz that even if the DA’s office agreed to the modification he probably would not have granted one because the prison report on Diaz indicates he has received two misconducts while in custody (most likely for fighting, marijuana or an illegal cell phone he is known to be using on a regular basis).

In reality, nothing about the motion being denied was unexpected (except maybe to Diaz and his supporters!). The law is pretty spelled out; the DA’s office was clear they didn’t agree to the modification and having two misconducts is almost a guarantee to not having your sentence modified. JohnTV just wonders how much money Diaz’s supporters spent wasting everyone’s time?
But, it wasn’t a total waste. Things got interesting after the hearing.
As Diaz’s supporters happened to be standing quietly in the hallway on the 7th floor of the Oklahoma County Courthouse, a DOC guard escorting Diaz came out and told everyone they needed to leave (for safety reasons) before they could bring Diaz out of the courtroom. Call it coincidence or call it racism, but all of Diaz supporters were either black or Hispanic and all were made to leave the public space they were quietly occupying. JohnTV’s Brian Bates (who is white) was also standing in the hall (only 10 feet from Diaz’s supporters – and sat with Diaz’s supporters in the courtroom) and was not asked to leave the public space.
After all the minority members of the public were forced to leave the area, the (white) DOC guard escorted Diaz to the elevator. That is when Bates started recording Diaz and a minor confrontation began between Bates and the possibly racist DOC guard. You can see that interaction below…
JohnTV is at the courthouse often, and hundreds of prisoners are escorted through the public halls weekly. These same halls are most often filled with supporters, detractors, uninvolved members of the public and the media. Many of which are being loud, wielding cameras, etc. At no time have we EVER seen a guard order the public out of a public space so they can move a prisoner to an elevator – much less all the minority members of the public. There was no legal reason for the guard to act the way he did towards Diaz’s family, friends and supporters.
Despite Diaz’s motion being denied, he is actually up for possible parole this October.
JohnTV will be organizing a letter writing campaign to try and convince the pardon and parole board not to grant Diaz parole.
